Terms

How the work runs, in the same plain terms as everything else here. These apply to the free audit and to any monthly or one-off work that follows.

Who these terms are between

SNDR is a one-person freelance email marketing business, registered in the UK, working with shops anywhere. In these terms, "I" means SNDR and "you" means the business commissioning the work.

By requesting the free audit or agreeing to a plan, you accept these terms. If you have your own contract you would rather use, send it over and I will read it properly.

The free audit

The audit is free, has no obligation attached, and takes five working days from the point I have what I need. You keep it either way, including if the answer is that email is not your priority this quarter.

To do it I need read access to your email platform, or the equivalent screenshots. Access is used for the audit and nothing else, and is removed as soon as it is finished if no work follows.

What the work covers

What is in scope is whatever the plan you agreed says: see pricing for the plans and services for what each piece of work involves.

  • Copy, design, build, testing and scheduling within the agreed volume.
  • Two rounds of changes on each send. Further rounds are possible and get quoted.
  • Work happens in your platform, on your account, on your list.
  • Anything outside email, such as ads, SEO or social, is not part of this and I will tell you so rather than take it on badly.

Timelines depend on you too. If a brief or an approval is late, the send date moves rather than the quality dropping.

Who owns what

  • Your account is yours. I am added as a user and removed the day you ask.
  • Your list is yours. Never exported, never reused, never moved somewhere I control.
  • Your templates and flows are yours. Built in your platform, and they carry on working after I stop.
  • Your data. Handled as described in the privacy policy. Subscriber data I touch on your behalf is processed for you and not for me.

I may refer to the work in general terms as an example, without naming you or sharing numbers, unless you tell me not to.

Notice and ending it

Monthly work runs month to month with one month’s notice on either side. No minimum term, no lock-in, no set-up fee to recover on the way out.

Work in progress at the point notice is given gets finished. Nothing gets switched off or deleted when I leave, because none of it lives with me.

I may end an arrangement with the same notice, and will say plainly why. The most common reason is that the work is not earning enough to justify what you are paying for it.

Limits, and the law that applies

Email results depend on your products, your prices, your list and your market as much as on the sending. I will tell you what I expect and why, but I do not guarantee a specific revenue figure, open rate or growth number, and you should be suspicious of anyone who does.

I am not liable for losses caused by a platform outage, a deliverability decision made by a mailbox provider, or content you approved. Liability is limited to the fees paid for the work in question.

You are responsible for having a lawful basis to email your own list. I will flag it if something looks wrong, and I will not send to a list that has been bought.

These terms are governed by the law of England and Wales.
